In response to research revealing the importance and uniqueness of deepwater coral habitats in the South Atlantic, coupled with new reports prepared for the South Atlantic Fishery Management Council (SAFMC) by J. Reed and S. Ross, SAFMC decided to propose Habitat Area of Particular Concern (HAPC) designation for six deepwater coral areas to extend them a higher level of protection. SAFMC's Habitat and Coral Advisory Panels proposed these areas at the October 2004 meeting and SAFMC approved the proposal at their December 2004 meeting. At their joint meeting in Miami in June 2006, the Habitat and Coral Advisory Panels received updates on recent research on the status and distribution of deepwater coral systems in the region. Based on this new information, the Panels proposed to consolidate and expand the 6 original areas into 4. SAFMC subsequently voted to adopt the Panels' proposal. Action to establish the 4 new deepwater coral HAPCs were taken through the Comprehensive Fishery Ecosystem Plan Amendment. At their joint meeting in Charleston in November 2007 Habitat and Coral Advisory Panels received more updates on the status and distribution of deepwater coral systems in the region. Based on this new information, the Panels proposed to reaffirm the 4 areas and add a fifth, the Blake Ridge Diapir. SAFMC subsequently voted to adopt the Panels' proposal for inclusion into the public hearing draft for the Comprehensive Ecosystem-Based Amendment. SAFMC submitted the Comprehensive Ecosystem-Based Amendment (CE-BA 1) and associated final environmental impact statement (FEIS) for review, approval, and implementation by NOAA Fisheries Service. The final rule was published in the Federal Register on June 22, 2010 (75 FR 35330) and the provisions were effective July 22, 2010. CE-BA 1 amended the Coral, Coral Reefs, Live/Hard Bottom Habitats of the South Atlantic Region Fishery Management Plan (Coral FMP) to establish Coral Habitat Areas of Particular Concern (CHAPCs) to protect what is believed to be the largest distribution of deepwater coral ecosystems in the world. In the South Atlantic region, deepwater coral ecosystems are coral, coral reefs, and live/hardbottom habitat in waters extending from 400 meters (1,300 feet) to the seaward boundary of the exclusive economic zone. Within the CHAPCs, the possession of coral species and the use of all bottom damaging gear is prohibited including bottom longline, trawl (bottom and mid-water), dredge, pot or trap, or the use of an anchor, anchor and chain, or grapple and chain by all fishing vessels. Recent deepwater scientific exploration and research have identified areas of high relief features and hard bottom habitat outside the boundaries of existing CHAPCs. During their October 2011 meeting, the Coral Advisory Panel recommended SAFMC revisit the boundaries of the Oculina Bank HAPC, Stetson-Miami Terrace CHAPC, and Cape Lookout CHAPC to incorporate areas of additional deepwater coral habitat. SAFMC reviewed the recommendations and associated Vessel Monitoring System (VMS) analyses of rock shrimp fishing activity for expansion of these areas, and provided guidance to develop the actions through a Coral Amendment. Coral Amendment 8 expands a portion of the western boundary of the Stetson Reefs, Savannah and East Florida Lithoherms, and Miami Terrace Deepwater CHAPC, including modifications to the shrimp access area A, which is renamed “shrimp access area 1”; and expands a portion of the northern boundary of the Cape Lookout CHAPC. In addition, this rule makes a minor administrative change to the names of the shrimp fishery access areas.

The Miami Terrace C-HAPC was expanded to the edge of the EEZ to the east (to include mound and pinnacle structures that extend toward and into the Bahamian EEZ. The southwestern boundary of the Stetson/Savannah and East Florida Lithoherms/Miami was extended westerly to the NCDDC Bathmetry 300 meter contour from the southwest corner of the CHAPC to a location of -79.88, 26.28 decimal degrees, which coincides with the originally proposed Miami Terrace CHAPC northern boundary.
